DMCA Policy

OmneHosting (“we,” “us,” or “our”) respects the intellectual property rights of others and expects customers to do the same. This DMCA Policy explains how to report claimed copyright infringement on content hosted through our services and how affected customers can respond.

1. Reporting Infringement

If you believe content hosted on one of our customers' servers infringes a copyright you own or control, send a written notice to our designated agent, listed in Section 5, including:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it (for example, a server hostname/IP, game server name, or file path).
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Notices that do not substantially include this information may not receive a response.

2. Our Response

Upon receipt of a valid notice, we will remove or disable access to the identified material and notify the affected customer of the takedown and the reason for it. We may suspend or terminate the affected server if the customer does not resolve the issue.

3. Counter-Notification

If you are a customer and believe material we removed was taken down in error or misidentification, you may submit a counter-notification to our designated agent that includes:

  • Your physical or electronic signature.
  • Identification of the material removed and its location before removal.
  • A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district where your address is located (or, if outside the United States, any judicial district in which OmneHosting may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we may restore the material unless the original complainant informs us that they have filed a court action to restrain the customer from the infringing activity.

4. Repeat Infringers

Consistent with Section 2 of our Acceptable Use Policy, accounts identified as repeat copyright infringers will be suspended or terminated.

We may update this DMCA Policy from time to time. When we do, we will update the “Last Updated” date above.
