Terms of Service
By accessing and using the services provided by OmneHosting (hereinafter, “OmneHosting,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (ToS), our Acceptable Use Policy, our Refund Policy, and our Privacy Policy.
1. Eligibility and Accounts
1.1 Age and Capacity
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and enter into these Terms on your own behalf. If you are between 13 and 18 years old, a parent or legal guardian must create the account, agree to these Terms on your behalf, and remain responsible for all charges, conduct, and content associated with the account. Our services are not directed at children under 13, and accounts found to be operated by someone under 13 will be suspended.
1.2 Account Accuracy
You are responsible for providing accurate registration and billing information and for keeping it current, and for all activity that occurs under your account credentials.
2. Service Provision and Account Management
2.1 Service Guarantee
OmneHosting commits to providing premium game server hosting services with a 99.9% Uptime Guarantee, as further defined in our Service Level Agreement. Hardware issues and planned maintenance are excluded from this calculation.
2.2 Data and Backups
You are solely responsible for the content, data, and files maintained on your game server. OmneHosting does not guarantee the integrity of any data stored on our systems. While we may perform routine backups for disaster recovery, you must maintain your own independent, external backups of all server files and configuration data.
2.3 Termination of Service
We reserve the right to suspend or terminate your service immediately, without prior notice, if you breach any section of these ToS, including the Acceptable Use Policy, or fail to make timely payments.
2.4 AI Support Assistant
Some support answers are written by an AI assistant, in your account chat or as replies on support tickets. Its replies are labeled and can be wrong or incomplete. They are general help, not a binding statement of our policies, pricing, refunds or your rights, which are set by these Terms and the policies they incorporate. Refunds, billing changes, account or security changes and similar decisions are made by our staff. You can ask for a person at any time, and you can turn off AI replies on a ticket by typing STOP in it. Do not send passwords, payment card numbers or other sensitive information to the assistant or in tickets. What we do with the text you send is described in our Privacy Policy.
3. Billing and Payment (Via Paymenter)
3.1 Billing Cycle
Services are billed on a recurring basis — monthly, quarterly, semi-annually, or annually depending on the billing cycle selected for your plan at checkout. You agree to submit payment for services in advance of each service period.
3.2 Payment Information
All billing and payment processing are handled through the Paymenter platform and its integrated third-party payment gateways. You agree to keep your billing information accurate and current.
3.3 Non-Payment
Failure to pay invoices within 48 hours of the due date may result in the automatic suspension and, subsequently, termination and deletion of your game server data.
4. Refunds
Refunds are governed entirely by our Refund Policy, which is incorporated into these Terms by reference. In summary: new game server orders qualify for a no-questions-asked refund within 3 days (72 hours) of purchase, requests made between days 4–7 are reviewed by support ticket at our discretion, and VPS services are not refundable. If anything on this page conflicts with the Refund Policy, the Refund Policy governs.
5. Acceptable Use
You agree to use OmneHosting’s services strictly for their intended purpose (running legitimate game servers and related applications) and to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Prohibited activities include, without limitation, illegal content, network abuse (including DDoS attacks and botnets), cryptocurrency mining, malware distribution, spam, and copyright infringement.
Violation of the Acceptable Use Policy is grounds for immediate service suspension or termination, and we reserve the right to remove any illegal, obscene, or infringing materials from our servers at any time.
6. Copyright (DMCA)
If you believe content hosted on our services infringes your copyright, see our DMCA Policy for our notice-and-takedown process and designated agent contact information.
7. Limitation of Liability
OmneHosting shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services, including, but not limited to, loss of data, income, or profits, regardless of whether we were advised of the possibility of such damages.
8. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date above. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
